Wage Earner Protection Program (WEPP) - New Feature / Changes

CAIRP is issuing the following BULLETIN on behalf of Service Canada. CAIRP members are the first trustees to receive HRSDC’s advisories. Non-member trustees usually have to wait until HRSDC posts them on its website. This is clear recognition by HRSDC of CIRPs’ importance in the WEPP process; it is also added value that the Association delivers to members.

Service Canada is committed to improving the delivery of its programs and services to Canadians, by making access to them faster, easier, and more convenient. The following changes are effective as of February 1, 2010.

1) WEPP – On-line Trustee/Receiver Information Form – Proof of Claim (POC) Amendments

Service Canada has made improvements to the on-line process in order to allow trustees/receivers to report to Service Canada that a POC has been submitted. This change is in force as of February 1, 2010. This important enhancement will expedite processing of the Trustee Information Form on-line for these cases where the only amendment relates to a proof of claim filed by an applicant.

2) WEPP – Trustee/Receiver Information Form (TIF) – Employee Information

Question 30 of the Trustee Information Form has been revised to allow for more specific reporting of the portion of eligible wages that has been paid to the employee since the date of the bankruptcy/receivership and to better reflect the revised wording of section 6 of the amended WEPP Regulations. The following new wording for Question 30 of the TIF is effective as of February 1, 2010:

Since the date of bankruptcy/receivership, has the employee been paid any amount:
Yes            No
If yes, please complete the following. The employee was paid:
(a) an amount from the current assets under sections 81.3 or 81.4 of the BIA in respect of eligible wages owing during the six-month period ending on the date of bankruptcy or receivership. Please indicate the amount: $__________; and/or
(b) other amounts by virtue of any rights in respect of eligible wages owing during the six-month period ending on the date of bankruptcy or receivership (e.g. under s. 136 (1)(d), other statutes or any other rights). Please indicate the amount: $__________.

This change will better ensure the accuracy of the WEPP payment amounts issued to applicants and will assist in minimizing the potential of overpayments.

Should you have other suggestions for improvement to the on-line process, we suggest you provide your recommendations to the CAIRP Executive, who will bring them to the attention of the WEPP Joint Liaison Committee for consideration. The Joint Liaison Committee comprises representatives from the Labour Program- Human Resources and Skills Development Canada (HRSDC), Service Canada-HRSDC, Canada Revenue Agency, Industry Canada and CAIRP. The committee’s mandate is to consider options to improve the effectiveness and efficiency of the WEPP. Service Canada will assess all feedback received and take it into consideration. ▪
